STATEMENT IN RESPONSE TO KPK’S APPARENT BREACH OF FUNDAMENTAL FAIRNESS UNDER LAW ON SJAMSUL NURSALIM

Without commenting on the specifics of this matter, it is clear that KPK’s naming of Sjamsul Nursalim and his wife Itjih as suspects in the media is a staggering breach of the most basic principles of fairness under the rule of law. Both Sjamsul Nursalim and his wife have dedicated their lives to empowering Indonesians by founding value creation companies providing sustainable business ventures, outstanding employment opportunities and social endeavours that continue to this day.

It is a violation of due process to brand them as suspects when Indonesia’s President decree, Ministry of Finance, IBRA and BPK confirmed that Mr Nursalim fulfilled all of their obligations under an agreement with the Indonesian government as far back as 1999 in a release and discharge under the MSAA agreement witnessed by international parties.

Besides the dispute KPK raised on any outstanding loan by the Farmers not even the Nursalims' obligation should be in the civil courts.
Sjamsul Nursalim and his wife Itjih are innocent of any wrongdoing whatsoever, and will aggressively fight back against KPK’s unjustified attacks against them in the media. Make no mistake about it, KPK’s action ignores the clear and undisputed record of the Nursalims’ settlement of all outstanding issues with the Indonesian government decades ago.

In addition to tarnishing Mr. Nursalim and his wife, KPK’s actions threaten the confidence of the international community and the sanctity of contracts for those who conduct business with the country. If there is legal certainty and full transparency of facts we are confident that all parties in this matter will be exonerated.
